2. Warranty

All of T4Tracks products carry a 1 year warranty period. This is against faulty workmanship or faulty materials. This warranty period starts from the date of delivery. In the event of a claim under this warranty, please contact us by email on [email protected].
Warranties may not be assigned to a third party.
Our warranty does not cover general wear and tear, neglect or abuse of your product, loss or damage (including rusting and corrosion) due to unreasonable exposure to water or weather; loss or damage due to fire, sunlight or infestation by animals or insects, theft or accidental damage or loss caused by a third party.
Our duty under this warranty is, at our option 1.) to repair or replace the defective product if returned to us (postage/insurance prepaid by you), or 2.) the shipment of a replacement within 30 working days at our expense, or 3.) a refund of the purchase price if the product is returned to us (postage/insurance prepaid by you).
T4Tracks are not liable for any claim, loss or damage of a product. Nor for lost profits or any other indirect damages caused by the product. This is with the exception of the aforementioned warranty of faulty workmanship or faulty materials within 1 year.
You the buyer agree that all liability of ours and our affiliates under this agreement will be limited to the money paid to us for the product purchased.

3. Price and Payment

The price of the goods shall be that stipulated by T4Tracks.
Payment of the total order price plus VAT (if applicable) and delivery charges must be made in full before dispatch of goods or before fitting work is carried out.

4. Returns Policy - Defective or Damaged Goods

You should inspect the Goods immediately upon receipt and notify us by email within 48 Hours of delivery if the Goods are damaged. You will be deemed to have accepted the Goods if you have not contacted us within 7 working days of delivery. On receipt of your email we will contact you.
Where a claim of defect or damage is made we will contact you by email or phone to arrange return of the Goods. You will be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective.

5. Our Rights
We reserve the right to:

Modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website;
Change the Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase. Your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website;
It is illegal to copy any images and product descriptions from OnTrack.uk.com website without our permission. We have been given permission to use images provided by our suppliers and have altered them to suit our site. This is an infringement of copyright and we will take legal advice if anyone is found to be doing so. Periodically update prices on the Website, which cannot be guaranteed for any period of time. We shall make every effort to ensure prices are correct at the point at which you place an order;
Withdraw any goods from the Website at any time. We shall not be liable to anyone for Withdrawal of Goods from the Website or for refusing to process an order. Whilst we make every effort to make online shopping an enjoyable process we may refuse to process an order if we suspect credit card fraud, we may contact you and will only process the order if we believe the details are legitimate.

6. Limitation of Liability

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller's agents or employees.

7. Waiver
No waiver by us (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

8. Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

9. Governing Law and Jurisdiction.
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
